Indian court case types and legal-help guide

A label such as “civil case” or “criminal case” may cover several procedures. The correct case type depends on the relief, statute, court, existing order and procedural stage—not only the words used in a search.

Civil and commercial proceedings

  • Civil or original suits, commercial suits, injunction, declaration, possession and specific performance
  • Rent proceedings, land-acquisition disputes, execution applications and civil miscellaneous applications
  • First and second appeals, civil revisions, reviews, caveats and interim applications

Criminal proceedings and bail

  • Criminal complaints, sessions trials, summary trials, regular bail and anticipatory bail
  • Criminal appeals, revisions, writs, quashing petitions and miscellaneous criminal applications
  • Special-statute matters such as NDPS or SC/ST Act proceedings require statute-specific review

Writ, constitutional and Supreme Court matters

  • Civil or criminal writ petitions, habeas corpus, public-interest litigation and contempt
  • Special Leave Petitions, civil or criminal appeals, transfer, review and curative petitions
  • Maintainability, alternative remedies, limitation and territorial jurisdiction can be decisive

Family, succession and protective proceedings

  • Divorce and matrimonial petitions, custody, guardianship, visitation, maintenance and domestic violence applications
  • Probate, testamentary proceedings, letters of administration and succession certificates
  • Orders may be interim or final; enforcement and appeal routes differ

Corporate, insolvency, tax and specialist tribunals

  • Arbitration petitions, company petitions and IBC matters before NCLT or NCLAT
  • Income-tax, GST and customs/excise appeals before the relevant statutory forums
  • DRT/DRAT, NGT, CAT, AFT, consumer commissions and other specialist adjudicatory bodies

What to bring to a consultation

Prepare a dated chronology, party names, all orders and notices, pleadings if available, key contracts or personal documents, the next hearing or response date, and the outcome you seek. Do not omit an adverse order or missed deadline.
