Divorce lawyer for NRIs in the UAE and the Gulf

In many families one spouse works in the Gulf while the home, the marriage and the children are in India. For that common situation, the Indian court where the family lives is normally the right forum. Advocate Aayush Agarwal handles these cases for clients in the UAE, Saudi Arabia, Qatar, Kuwait, Oman and Bahrain.

The usual Gulf case: family in India, income abroad

A wife living in India can generally seek divorce, maintenance and custody where she lives. The spouse in the Gulf can respond through a Special Power of Attorney and video hearings. A Gulf court order may not end the marriage for Indian purposes, so an Indian decree is normally needed.

Which attestation applies in your country

The UAE, Saudi Arabia, Oman and Bahrain have joined the Hague Apostille Convention in recent years, so an apostille from the competent authority may be enough. Other Gulf states may still need the foreign ministry’s attestation followed by the Indian Embassy’s. This has changed recently, so confirm the rule for your country and document before signing.

Maintenance and income earned abroad

Calls with little time difference

The Gulf is only 1.5 to 2.5 hours behind India, so live hearings and calls are easy to arrange without early mornings or late nights.

Frequently asked questions

Can I get divorced in India while working in the Gulf?

Usually yes. A Special Power of Attorney and video hearings cover most steps, and the time difference is small.

Is an apostille enough in Dubai or Abu Dhabi?

The UAE joined the Apostille Convention recently, so an apostille may be enough. Confirm the current rule for your document before you sign.

Does my Gulf salary affect maintenance?

Yes. Income earned abroad counts and must be disclosed by affidavit.

What if my country is not a party to the Convention?

You may need attestation by the foreign ministry and then the Indian Embassy. Ask us before you sign.
