Divorce and family lawyer in Gurugram

Advocate Aayush Agarwal advises Gurugram couples on divorce, child custody, maintenance and protection from domestic violence — including couples who moved to Gurugram for work and spouses living abroad.

Two routes: mutual consent or contested

In a mutual consent divorce both spouses agree to separate and settle alimony, custody and property in writing. A first motion is followed by a second motion after the statutory waiting period, which the Supreme Court has allowed courts to waive where everything is settled (Amardeep Singh v. Harveen Kaur). In a contested divorce one spouse files on a legal ground such as cruelty or desertion and must prove it with evidence, which usually takes longer. Mediation is available at any stage.

Where a Gurugram divorce is filed

A petition can be filed where you married, where the other spouse lives, or where you last lived together. If that is Gurugram, the family court at the Gurugram district courts hears the case, and appeals go to the Punjab and Haryana High Court.

Frequently asked questions

How long does a mutual consent divorce take in Gurugram?

If both spouses agree and the paperwork is complete, it can finish in a few months. The waiting period between the two motions can be waived by the court in suitable cases.

We married in another state. Can I file in Gurugram?

Often yes, if you last lived together in Gurugram or the other spouse lives here. A wife can also usually file where she lives. Share your address history and we will confirm.

What happens to a flat and home loan we hold jointly?

Ownership follows the title documents, and the loan stays with the borrowers. The settlement or court order should state who keeps the flat, who pays the EMI and how any buyout works.

Can the first consultation be on WhatsApp?

Yes. The first consultation is free and can be by WhatsApp, phone or video.
