Divorce lawyer for NRIs in the UK
The United Kingdom has more than one divorce system, and an Indian marriage has to be dealt with in India as well. Advocate Aayush Agarwal coordinates with UK solicitors for clients in London, the Midlands, the North, Scotland and Wales.
England and Wales, Scotland, and the Indian marriage
In England and Wales, the no-fault divorce law introduced in April 2022 lets a spouse apply by stating that the marriage has broken down irretrievably, with a minimum period of roughly six months from application to final order. Scotland has its own divorce law and procedure. None of these decrees automatically ends an Indian marriage for Indian purposes, and an Indian decree may in turn need recognition in the UK.
Authentication through the UK legalisation office
The UK and India both belong to the Hague Apostille Convention. A Special Power of Attorney or affidavit signed before a solicitor or notary is normally given an apostille by the UK government’s legalisation office. Check current timings before you sign.
Money, pensions and children
- UK courts can divide pensions and property in ways Indian courts do not, so a financial order there and a maintenance claim here should be planned together.
- Arrangements for children should work in both countries, especially if a child will visit India.
- A spouse who left the UK, or one who lives in India, raises questions about which court has jurisdiction.
Calls that fit a UK evening
India is 4.5 to 5.5 hours ahead of the UK, so a call at 6 pm in London reaches India at about 11 pm or midnight. Most clients prefer lunchtime or early evening UK slots.

Frequently asked questions
Can I divorce in India while living in the UK?
Usually yes. A Special Power of Attorney and video hearings cover most steps.
I have a UK decree. Does it end my marriage in India?
Not automatically. An Indian court examines a foreign decree before treating the marriage as ended.
Is the Indian process as quick as UK no-fault divorce?
An agreed mutual consent divorce in India can take a few months. A contested case often takes longer.
Who advises me on the UK side?
A UK solicitor. We work alongside them so the English or Scottish case and the Indian case fit together.
