How a Special Power of Attorney from abroad works

You sign the document before a notary and then have it authenticated for use in India. Canada and the USA are parties to the Hague Apostille Convention, so an apostille is normally used. Gulf countries differ: the UAE, Saudi Arabia, Oman and Bahrain have joined the Convention in recent years, while others may still need attestation by the foreign ministry and the Indian Embassy. Rules change, so confirm the current process for your country before you sign.

Time zones and communication

Consultations run by WhatsApp, phone or video at times that suit your time zone, and documents are shared securely online. You receive regular updates on every hearing.

Frequently asked questions

Do I have to come to India?

Usually not. A Special Power of Attorney lets a trusted person act for you, and courts often allow appearance by video conference. Some stages may still need your presence, and we will tell you in advance.

How long does attestation take?

It varies by country and authority, from days to a few weeks. Start the process early, and ask before you sign, because a document attested the wrong way may have to be repeated.

Is a foreign divorce decree valid in India?

Not automatically. An Indian court examines a foreign decree under Section 13 of the Civil Procedure Code, and a decree obtained without the other spouse’s real participation can be challenged.

Can a family member represent me?

A family member can hold your Special Power of Attorney for practical steps, but court appearances are made by an advocate. We coordinate with the person you appoint.
