How to choose a divorce lawyer in India
Searching for the best divorce lawyer? The best lawyer for you is one who is properly enrolled, experienced in your kind of case, honest about outcomes and easy to reach. Use this checklist, whichever lawyer you end up choosing.

1. Verify enrolment
Every advocate must be enrolled with a State Bar Council. Ask for the enrolment number and check it on the Bar Council’s own list. Advocate Aayush Agarwal’s enrolment number with the Bar Council of Delhi is D/6955/2018, which you can check on the Bar Council of Delhi enrolment page.
2. Match the lawyer to your kind of case
- Mutual consent needs careful drafting and settlement.
- Contested cases need evidence and trial experience.
- NRI cases need knowledge of attestation, jurisdiction and recognition of foreign decrees.
- Domestic violence or false allegations need quick, careful handling of criminal and civil remedies.
Ask how many matters of your kind the lawyer has handled, and in which courts.
3. Ask these ten questions in the first meeting
- Which court will hear my case, and why?
- Which route do you suggest — mutual consent or contested?
- What is the realistic timeline?
- What are the risks?
- What documents do you need from me?
- Who will appear in court?
- How will you keep me updated?
- Can I speak to you between hearings?
- What is outside your scope?
- What will it cost, in writing?
4. Understand the fee structure in writing
Fees can be a fixed amount for a stage of the case or an amount per appearance. Under the Bar Council of India Rules an advocate cannot charge a fee that depends on winning the case. Get the scope and fee in writing before paid work begins, and ask what court fees and expenses are extra.
5. Red flags
- A guaranteed result or a promise to “win”.
- Pressure to decide or pay immediately.
- Refusal to put the scope and fee in writing.
- Advice to hide income or assets, or to delete messages.
- Claims of a 100 per cent success rate — no honest lawyer can promise this.

Frequently asked questions
How do I find the best divorce lawyer near me?
Shortlist two or three advocates, verify their enrolment, and meet or call each one. Compare how clearly they explain your options, the court and the timeline, not how loudly they promise results.
Is a more expensive lawyer a better lawyer?
Not necessarily. Compare experience in your kind of case, clarity of communication and a written scope. A high fee does not guarantee a better outcome.
Can I change my lawyer in the middle of a case?
Yes. You can engage another advocate, and the new advocate files a fresh authority. Settle outstanding dues and collect your documents first.
Do I need a lawyer in the same city as the court?
Not necessarily. Many steps are handled by phone and video, and an advocate can appear where the case is filed. Ask who will appear and how you will be updated.
